The burial ground dates from the 1810s, though the first recorded instance of a Jewish presence in Edinburgh occurs in two entries in the Burgh Records for 1691.

4th September 1691 -- The Counsell having considdered the representation given in be David Broun jew with the severall solicitations in his favores by persones of quality Doe therfor grant the said David Broun the libertie of trading within this city and suburbs thereof during the Councills pleasure.

9th September 1691 -- William Patoun old dean of gild protested that David Broun jew can have noe priviledge of tradeing conform to the act of Councill in his favours presently read being against the standing law of the nation and acts of burrowes [towns] and that noe persone whatsomever that denyes the basis or foundamentalls of our Christian religion can have any priviledge whatsomever within the city of Edinburgh or suburbs. As the said David Broun does not deny he being a profest jew And therfor took instruments To which Hugh Blair old thesaurer [town treasurer] gave answer... Whereas it is alleadged that this is contraire to the standing lawes of this Kingdome It is denyed that there are laws in this Kingdome restraining Jewes fra liberty of trade And where the lawes are most severe against the adversaries of the trew religion [Protestantism] whither subjects or strangers ther returning to or remaining in this Kingdom unless they obey the law yet ambassadours messengers or merchants are excepted James VI Parliament seventh. Cap. 105, whereas It is allegit to be against reason that they that deny the foundamentalls of our religion should have or enjoy any civill priviledge Its answered that Jewes as such are not to be considdered or treated as other infidels They being the ancient people of God of the seed of Abraham... And from them have wee handed down to us the law and the Gospell... And though now in their rejected state they are enemies to the gospell for our sake Yet as touching the election [being chosen by God for salvation] they are beloved for their fathers sake upon which and severall other accompts [accounts] It is that they are allowed the libertie of trade in places of greatest trade where the reformed religione is professed.
